1. Definitions
In these Terms, "LinkDaddy Media", "we", "us", and "our" refer to LinkDaddy Media, operated by Anthony James Peacock. "Platform" means the website at linkdaddymedia.com and all associated services. "User", "you", and "your" refer to any individual or entity that accesses or uses the Platform. "Content" means any image, text, metadata, or other material uploaded to or generated by the Platform.
2. Acceptance of Terms
By registering for an account, uploading content, or otherwise accessing the Platform, you confirm that you are at least 18 years old, have read and understood these Terms, and agree to be bound by them. If you are using the Platform on behalf of a business or other legal entity, you represent that you have the authority to bind that entity to these Terms.
3. Account Registration and Security
You must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your password and for all activity that occurs under your account. You must notify us immediately at [email protected] if you suspect any unauthorised access to your account.
We reserve the right to suspend or terminate accounts that provide false information, violate these Terms, or engage in any activity that is harmful to the Platform or other users.
4. Acceptable Use Policy
You agree not to use the Platform to:
- Upload images or content to which you do not hold the necessary rights.
- Upload images containing illegal content, including but not limited to child sexual abuse material (CSAM), content that glorifies violence, or content that infringes third-party intellectual property rights.
- Attempt to reverse-engineer, scrape, or systematically download content from the Platform without our prior written consent.
- Use the Platform to generate or distribute spam, phishing content, or malware.
- Circumvent any access controls, rate limits, or security measures implemented by the Platform.
- Impersonate any person or entity or misrepresent your affiliation with any person or entity.
- Use the Platform in any way that violates applicable local, national, or international law or regulation.
We reserve the right to remove any content and suspend or terminate any account that we determine, in our sole discretion, violates this Acceptable Use Policy.
5. Your Content and Intellectual Property
You retain all ownership rights to images you upload to the Platform. By uploading an image, you grant LinkDaddy Media a non-exclusive, worldwide, royalty-free licence to store, process, and deliver that image solely for the purpose of providing the Platform's services to you.
You represent and warrant that you own or have the necessary rights, licences, consents, and permissions to upload each image, and that your content does not infringe the intellectual property rights, privacy rights, or any other rights of any third party.
6. CC0 Public Commons Licence Grant
When you choose to publish an image to the LinkDaddy Media Public Commons, you irrevocably dedicate that image to the public domain under the Creative Commons CC0 1.0 Universal Public Domain Dedication. This means:
- You waive all copyright and related rights in the image to the fullest extent permitted by law.
- Any person may copy, modify, distribute, and use the image for any purpose, including commercial purposes, without asking permission and without attribution.
- This dedication is permanent and cannot be revoked once the image has been published to the Commons.
You must only publish images to the Commons that you have the right to dedicate to the public domain. Do not publish images that contain recognisable individuals without a valid model release, images of private property without a property release, or images to which a third party holds copyright.
Images generated by the Platform's AI generation feature using your prompt are owned by you and may be published to the Commons subject to the above conditions.
7. DMCA Copyright Infringement Policy
LinkDaddy Media respects intellectual property rights and complies with the Digital Millennium Copyright Act (DMCA). If you believe that content on the Platform infringes your copyright, please send a written notice containing the following information to [email protected]:
- A physical or electronic signature of the copyright owner or a person authorised to act on their behalf.
- Identification of the copyrighted work claimed to have been infringed.
- Identification of the material that is claimed to be infringing, with sufficient information to locate it on the Platform (e.g., a URL).
- Your contact information, including name, address, telephone number, and email address.
- A statement that you have a good-faith belief that use of the material in the manner complained of is not authorised by the copyright owner, its agent, or the law.
- A statement that the information in the notification is accurate, and, under penalty of perjury, that you are authorised to act on behalf of the copyright owner.
We will respond to valid DMCA notices by removing or disabling access to the allegedly infringing content. Repeat infringers will have their accounts terminated.
8. Billing and Payments
Paid plans are billed monthly in advance. All prices are in US Dollars (USD) and are exclusive of applicable taxes. You authorise us to charge your payment method on a recurring basis until you cancel your subscription.
Image credits are allocated at the start of each billing cycle and expire at the end of that cycle. Unused credits do not roll over to the next cycle. Credits are non-refundable except as required by applicable law.
You may cancel your subscription at any time from your billing dashboard. Cancellation takes effect at the end of your current billing cycle. We do not provide pro-rata refunds for partial months.
We reserve the right to change our pricing at any time. We will provide at least 30 days' notice of any price increase via email to the address associated with your account.
9. Disclaimers and Limitation of Liability
The Platform is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Platform will be uninterrupted, error-free, or free of viruses or other harmful components.
To the fullest extent permitted by applicable law, LinkDaddy Media shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or in connection with your use of the Platform.
The EXIF metadata, XMP data, and schema markup generated by the Platform are provided as technical tools to assist with image SEO. We make no guarantee of specific search engine rankings or Knowledge Graph inclusion. SEO results depend on many factors outside our control.
10. Governing Law and Disputes
These Terms are governed by and construed in accordance with the laws of England and Wales. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
11. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes by email or by displaying a prominent notice on the Platform. Your continued use of the Platform after the effective date of any changes constitutes your acceptance of the revised Terms.
